1. Agreement to Terms

By accessing or using this website or enrolling in our services (driving lessons, courses, packages), you agree to be bound by these Terms. If you disagree with any part, you must not use our website or services.

2. Eligibility

You must be of the legal age in your jurisdiction or have parental / guardian consent to register for services. You confirm your information is accurate and lawful.

3. Services & Offerings

We provide driving instruction, road test preparation, Beginner Driver Education (BDE) and other related services, as described on our website. We may change, discontinue, or modify offerings at our discretion.

4. Registration, Payments & Fees

  • You must pay the applicable fees for services at the time of registration or as otherwise specified.
  • All fees are non-refundable except as stated in our refund/cancellation policy.
  • We reserve the right to change prices, add surcharges (e.g. travel, location-based), or fees at any time, but changes will not apply to already confirmed registrations (unless otherwise stated).
  • You are responsible for providing accurate billing information and ensuring payments go through.

5. Cancellation, Rescheduling & Refunds

  • If you cancel or reschedule, you must provide notice (e.g. 24 / 48 hours) before the lesson / service.
  • Late cancellations or no-shows may incur a fee or loss of the session.
  • Refunds (if any) will be processed by our payment system within a reasonable time.
  • We may cancel or reschedule lessons (e.g. due to instructor availability, weather, safety) and will attempt to provide notice and alternatives.

6. Obligations & Conduct

  • You must comply with all safety rules, instructions from instructors, traffic laws, and site rules.
  • You must not behave in a way that endangers yourself, instructors, or others.
  • You are responsible for arriving on time, having required documents (e.g. learner’s permit), and maintaining appropriate condition (e.g. health, ability).
  • You must disclose any condition or limitation that could affect your ability to drive (e.g. medical constraints).

7. Intellectual Property

All content on the website (text, logos, images, designs) is owned or licensed by us and is protected by copyright, trademark, and other rights.

  • You may view, download, or print for personal noncommercial use, provided you retain all copyright and proprietary notices.
  • You must not copy, distribute, modify, republish, publicly display, or create derivative works without our permission.

8. Disclaimer of Warranties / “As Is” & Liability Limitation

Our services, website, and materials are provided “as is” and “as available” without warranties of any kind (express or implied). We do not guarantee uninterrupted, error-free, or completely secure service.

To the maximum extent allowed by applicable law, we disclaim all liability for direct, indirect, incidental, consequential, special, or punitive damages arising out of your use of our services, website, or your inability to use them.

In no event shall our total liability to you exceed the total fees you paid us in the preceding [12 months / applicable period].

9. Indemnification

You agree to indemnify, defend, and hold harmless New Method Vaughan, its officers, instructors, employees, contractors, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your breach of these Terms, your misuse of the services, or violation of law.

10. Termination

We may suspend or terminate your access or enrollment (in whole or part) at our discretion, for breach of these Terms or misconduct. Upon termination, you must stop using our services. Any pending payments or obligations survive.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any dispute arising out of or relating will be resolved in the courts of Ontario (or another jurisdiction as appropriate). Parties may seek to resolve through negotiation or mediation first.

12. Severability

If any provision is held invalid or unenforceable, such provision will be struck to the minimum extent necessary and the remaining Terms shall continue in full force and effect.

13. Changes to Terms

We may modify or replace these Terms at any time, with notice (e.g. via website). Your continued use after changes indicates acceptance.
